英稅有計|誤買爛屋交足稅 業主有機「退回」3%印花稅今次筆者就先說一下特定情況下退回土地印花稅(Stamp Duty Land Tax)的方法。

持有多個物業需支付額外3%印花稅


英國房屋政策雖然與香港不盡相同,但假如個人或公司名義持有多過一個物業,政府都有類似「辣招」的稅收,幸好英國在方面的稅收沒香港那麼高,買家只需要支付樓價3%作為額外土地印花稅。


退回額外印花稅兩個方法

一,如果你在3年內出售主要住所,也可以申請退還這額外3%土地印花稅。根據規定,如果您在購買新的主要住所後的36個月內出售原有主要住所,你有資格申請退還額外支付的3%土地印花稅。


二,新的這一間屋「不再適合作為住宅」。你需要向英國稅務海關部HMRC證明這一間屋「不再適合作為住宅」,這才可以退回這額外3%土地印花稅支出。


物業需要符合「破敗」條件


或許讀者會有疑問,買家已為物業簽約,買賣過程經過律師樓仔細查證,做了資料搜集,亦可能經過測量師檢查物業,之後才付錢及完成交易,經過如此多關卡後,眼前明明白白便是一間住宅,如何向政府申報說這間住宅是「不適合作為住宅」呢?你需要證明這個物

業是處於「破敗」的狀態。


為「破敗」物業交這額外3%土地印花稅等同「交錯稅」,如果你的物業屬於「破敗」狀態,被認為是「不適合作為住宅」,由於根本無法居住,所以在法律上你所購入的就不算是「住宅」,屬於「非住宅物業」,而非住宅物業沒有要求交這額外3%土地印花稅,那麼買家當初買這個物業時如交了這額外3%土地印花稅就等如「交錯稅」,因為交稅的條件並不成立。如是者你就可以申請退回這3%土地印花稅。


聽起來有點取巧,但現實是有可能的,且已有許多案例實證。事實上,若干法庭案例已說明只要物業是不適合作住宅居住,它會被歸類為非住宅物業。筆者就曾經為一名不幸買了「破敗」物業的香港業主,成功申請退回土地印花稅。


「破敗」退稅在近年引起爭議


不過,其實這個退回稅項的方式早幾年開始受質疑,有聲音認為這個做法有利於買家。話說在2019年,Bewley先生買了一間屋及土地,這間屋裡面沒有鍋爐及供暖設備,且物業周遭都有石棉,他向HMRC交了一份稅務申報後,Bewley獲得批准將物業拆除重建,於是就跟太太拆了這舊屋,並建造了一間新屋。爭議點就在於Bewley持有多過一個物業,卻無須支付這額外3%土地印花稅稅項。
